DEED OF ADOPTION OF MALE CHILD FROM ORPHANAGE

 

This deed of adoption made this 18th day of ……. 20… between ….. son of …. aged about ….. years, by religion Hindu, residing at …………….. (Name of Place) (hereinafter referred to as the adoptive father) of the one part and ………, son of ….. aged about ……… years by religion Hindu, residing at ……………….(Name of Place) working as Superintendent of ......................having its registered office at ………(Name of Place) and Guardian of …. aged …….. years, one of the orphans, duly appointed by the Dist. Judge of ......................by an Order dated ……………….. 20….. (hereinafter referred to as the guardian) of the other part.

Whereas the adoptive father has no son, grandson or great grandson.

And whereas the adoptive father intends to adopt a son who would look after him in his old age and offer oblations to the adoptive father and his ancestors.

And whereas the adoptive father approached the said guardian who is in-charge of the ......................, a voluntary Social and Welfare Organisation, situate at ......................giving shelter and maintaining orphan children abandoned by their parents to give the adoptive father in adoption a suitable male child to be his adopted son.

And whereas the said guardian being satisfied about the bona fide intention of the adoptive father and also being satisfied that such adoption will be for the welfare and benefit of the child proposed aged ……. years named
……..

And whereas the adoptive father approved the selection of …… the guardian agreed to give …….. in adoption and…. expressed his willingness to be the adopted son of the said adoptive father.

And whereas the said ….. met the adoptive father and had discussions and expressed his willingness and gave his consent to be adopted by the ADOPTIVE FATHER as his Son.

And whereas the guardian applied to the Dist. Judge at ......................for the necessary permission to give the said …….. in adoption to the adoptive father and the said Dist. Judge gave permission to give ……….. in adoption to the adoptive father by an Order dated …….. 20… in Act VIII Case No..............of............

And whereas ….. the wife of the adoptive father has also given her consent to the said adoption of ….. by the adoptive father.

Now these presents witnesseth and the parties hereby record and agree as follows:

The said ….., the guardian as the Superintendent of ......................being fully satisfied after enquiries being made and reports obtained from reliable sources about the bona fide intentions of the adoptive father and that such adoption would be for the benefit and welfare of ….. has this day before the respectable persons and officials of the ......................put the said child in the possession of adoptive father who has physically received the said ….. in adoption as his son and that the said ….. shall have from this day full and complete right, title and interest in the property of the said adoptive father and his Joint Family and shall have all obligations of a son including the offering of oblations to the said adoptive father and his ancestors as required by Hindu Law and custom.
