Complaint under Section 98 of the Cr. P. C.
Respectfully Sheweth:
1. That the complainant above named is the father and lawful guardian of above said _________, who is aged about _____ years and as such minor.
2. That the daughter of the complainant was studying in ____________.
3. That on ______, the respondent No. 1 abducted the daughter of the applicant and the complainant started searching for her in the house of his relatives, acquaintances etc.
4. That however, after few days the complainant came to know about the whereabouts of his daughters who was found in the house of the respondent No. 1. The complainant keeping in view the family reputation and delicate issue, tried to persuade the respondent No. 1 and his father, mother and grandfather to send the daughter of the complainant back to the complainant,s house, but all the efforts failed. The respondent No. 1 and his father, mother and grand father told to the complainant that the daughter of the complainant has been got married to the respondent No. 1. Their such assertion is false and wrong and against the wishes of the complainant, the daughter of the complainant being minor.
5. That the complainant was contemplating of legal actions against the respondent No. 1 and his family members and in the meanwhile the complainant received a telephonic message from his daughter on ______ that she is being ill-treated by the respondent No. 1, his father, mother and grandfather and being beaten almost every day and tortured mentally and physically and asking her to bring money from her parents so that the respondent No. 1 can run some business etc. She is also being prevented from coming to her parents house by the respondent No. 1 and his parents and grandfather. She also informed that she never married with the respondent No. 1 and she is being unlawfully detained in his house or sometimes taken elsewhere against her wishes. She is apprehending that she may even be killed by the respondent No. 1 or his family members. She is being unlawfully detained by the respondent No. 1 in his house and against the wishes of the complainant and the respondent No. 2.
6. That the respondent No. 1 is a criminal by nature and he has already been locked up on various occasions, more particularly on ______ he remained under arrest in Police Station ______.
7. That the complainant is apprehending that his daughter may be physically harmed by the respondent No. 1 and his family members, and they may even kill her as on ______, the complainant with the help of the police from the Police Station, ______ succeeded in going to the house of the respondent No. 1, where he made a categorical threat of killing the daughter of the complainant.
8. It is, therefore, most respectfully prayed that the complaint may kindly be allowed and the search warrant may kindly be issued to the SHO, Police Station ______ directing him to produce the aforesaid respondents before the court and thereafter the minor girl aforesaid be restored to the complainant who is father and lawful guardian of the minor girl aforesaid.
