ASSIGNMENT OF RENT

 

THIS DEED of assignment of rent made this ______ day of 20 ____ between_______________ s/o ___________________ residing at ___________________  (hereinafter referred to as the vendor which term shall unless the context requires otherwise include his heirs, legal representatives and assigns) of the ONE PART.

 

AND

 ______________________ s/o ________________________ residing at ________________ (hereinafter called the purchaser which term shall include his heirs, successors and assigns) of the OTHER PART.

 

WHEREAS  by a Deed of Sale dated the day of ____________ has sold and conveyed to _________________ absolutely the land (describe the property), subject to the existing tenancy or tenancies of person or persons named in the schedule hereunder and whereas it has been agreed by and between both  that the said ______________ shall also transfer and assign unto and to the use of the said ___________________ all rents payable by all such tenants accrued up to and inclusive of the date of sale at and for the sum of Rs. _____________ now this deed witnesses that in pursuance of the said agreement and in consideration of the sum of Rs. ___________  paid by CD the receipt whereof the said ________________ hereby admits, acknowledges and confirms, the said _________________ does hereby grant, transfer and assign unto and in favor of the said __________________ all those rents and sums of money particulars whereof are specified in the Schedule hereunder and all benefits and advantages thereof and empower and authorize, ___________________ to have, receive, collect and realize the same either amicably or through court and appropriate the same for his absolute use and benefit.

 

And this Indenture further witnesses that the said ________________does hereby covenant with the said ________________ that all and every item of such rents and sums of money are still lawfully due and payable by the said respective tenants and that the said ____________ never received any advance against such rent or rents nor any part payment or any other deposit or deposits adjustable with the said rents nor released or committed to release or remit the same or any portion thereof nor written off any amount with intent to exonerate any tenant or tenants from his or their liability on that account. And further there is no injunction or prohibitory order against him from realizing the same or any portion thereof nor from assigning all such amounts in the manner hereunder effected.
