Deed of appointment of new trustees

________________________________________________________________________________________________________(Sole Surviving Trustee) (hereinafter referred to as .the Settlor.)

And

_____________________________________________________________________________________________(hereinafter referred to as .the Original Trustees.) it is inter alia provided that subject to the vesting of certain funds and the investments thereof in the Treasurer of Charitable Endowments, West Bengal, all properties, moveable and immovable, of the girls. school at......... under the name of............. shall at all times remain vested in the Original Trustees and/or the New Trustee or Trustees appointed under the provisions thereof.

 

AND WHEREAS it is by the said Indenture of Trust inter alia further provided that there shall at no time be more than five and less than three Trustees thereof and that each of the Original Trustees shall by deed only be at liberty to appoint a New Trustee to succeed him in his place and stead and that in the event of a Trustee dying or retiring without having appointed a successor to him the continuing Trustees or the sole surviving Trustee shall on such death or retirement fill up the vacancy.

AND WHEREAS save and except the sole surviving trustee who is continuing in office all other the Original Trustees have died without having at all appointed a successor in their respective places.

AND WHEREAS it is necessary that three New Trustees should be appointed to fill up the vacancies caused by the death of the Original Trustees ____________________________________________________________________ .

AND WHEREAS the moveable and immovable properties belonging to the said girls. school consist of the hereditaments mentioned and described in the first schedule hereunder written and the furniture, appliances, and all other thearticles and things specified in the second schedule hereunder written.

 

NOW THIS INDENTURE WITNESSETH that he the said F as the sole surviving Trustee of the said Indenture of Trust dated........... and in exercise of the power on him thereby conferred and of all other powers on him thereunto enabling hereby appoints the said _________________________________________________________________ to be the New Trustees thereof in the place of the said deceased. Original Trustees __________________________ to act jointly with the said ___________ to perform the trusts of the said Indenture of Trust.

 

AND IT IS HEREBY DECLARED that the estate and interest in the hereditaments mentioned and described in the first schedule hereunder written and in the furniture, appliances, and all other the articles and things specified in the second schedule hereunder written shall henceforth vest in the said F. and the said X.Y. and Z as joint tenants as such Trustees as aforesaid for the purposes of the trusts, uses powers and provisions of the said Indenture of Trust

dated......... (or the sole surviving Trustee and the said New Trustees shall henceforth stand vested with and possessed of the hereditaments mentioned and described in the first schedule hereunder written and the furniture,

appliances and all other the articles and things specified in the second schedule hereunder written as joint tenants upon the trusts and uses and subject to the powers, provisions and limitations expressed and declared of and concerning the same or such of them as are still subsisting and capable of taking effect). AND the said X., Y. and Z hereby respectively consent to be and to act as such New Trustees as aforesaid.
