Unitech ltd, the real estate firm has been asked by the apex consumer commission to refund over Rs. 4.3 crore to a home buyer after premium real estate firm failed to hand over the possession of a property even after four years of the promised delivery date.
The directors are directed by The National Consumer Disputes Redressal Commission to refund Rs. 4,37,98,966 to Gurgoan- resident Major(retd) Jaideep Singh. The said person had booked a flat in one of the projects of the firm in the year 2012. The real estate firm has been also directed to pay compensation amounting to Rs. 25,000 to Singh. According to the complaint filed in the year 2012, Singh booked a house in one of firm’s project that is, Espace Premier Nirvana Country-2 which was proposed to be developed at Sector 78 in Gurgaon. According to the sources, the property was supposed to be handed over in 24 months that is by April 2014.
Singh had paid Rs. 1.05 crore directly and rest through his banker. The commission very well noted that the firm was unable to fulfil its commitment over any particular date for the completion of project. The firm informed the panel about the project which is halted due to unavoidable circumstances which are beyond its control. It said that “since the availability of the sewerage treatment plants and water from such plants was very limited compared to the requirement, it becomes very difficult to maintain the timely schedule of construction”.
The commission has rejected all the claims of the firm on the basis that it had allowed several other complaints with regards to the same property.
