A PIL seeking a direction to the government to implement “Aadhar Based Property System” was heard by Supreme Court. The objective was to eliminate bogus votes and ensures maximum participation and link Aadhar with movable and immovable documents so that Benami transactions can be tackled.
The bench is headed by Chief Justice Dipak Misra and the petitioners are represented by Senior Advocate Vikas Singh and Delhi BJP leader advocate Ashwini Upadhaya. Singh. The petitioners have highlighted the importance of Aadhar. According to them, Aadhar as on date is one of the “most authentic databases of citizen and chances of duplication in Aadhar is negligible as it is beyond the realms of possibility and probability to fudge biometric details which is a pre-condition for Aadhar enrolment”. In the present case, use of Aadhar by the election commission will not help them of improving overall poll by enabling deletion of duplicate entries but will also benefit them to provide additional services.
In process of linking Aadhar with property, the eminent senior advocate highlighted that the main advantage of this strategy is that the tax authorities will get details about “legal owners” immediately. It will basically eliminate several black money hoarders, who register their property properties in others name after their signature. In such cases, the original property documents are kept by the original owners and in most of the cases they also keep the power of attorney signed by legal owner.
Looking in to benefits, once the linkage is done the tax authorities can approach the “legal owners” and it can be treated as benami property if the “legal owners are unaware or denies knowledge of the ownership”. Even if the legal owner takes onus and claims that it is his property, he is required to show the “source of income” for buying that property.
