The money of the Amrapali him buyers has been diverted illegally observed the Supreme Court. A company promoted by Mahendra Singh Dhoni, Rhiti Sports Management Pvt Ltd has been using the money of the home buyers.
On Tuesday, the Amrapali Group's Real Estate Regulatory Authority's licence was cancelled by Justice Arun Mishra and Justice U.U. Lalit. The National Buildings Construction Corp Ltd (NBCC) was appointed by the bench to complete the pending projects.
Between 2009 and 2015 Amrapali Group of Companies filled the pockets of Rhiti Sports Management Pvt Ltd with a huge sum of Rs 42.22 crore adding to this it was tipped with Rs 6.52 crore by the Amrapali Sapphire Developers Pvt Ltd.
The sum was paid on account of agreements executed by Anil Kumar Sharma, CMD of Amrapali Group of Companies, with Rhiti Sports Management Pvt Ltd.
The money was paid to Rhiti Sports Management Pvt Ltd. due to the agreement executed by the CMD of Amrapali Group of Companies, Anil Kumar Sharma
The court recorded that there was no proof authorising the agreement of the Amrapali Group authorising the CMD, Anil Kumar Sharma to enter into a agreement on behalf of the company.
The agreements signed on 22nd November 2009 between the company was pointed out by the court. Dhoni accompanied by a resentative of Rhiti Sports will be able to work with the Chairmen for three days.
Sponsorship Agreement dated 20th March 2015 between Amrapali Group of Companies and Chennai Super Kings, the Group got a logo space to advertise in various places in IPL 2015.
"It is observed that this agreement is on plain paper and executed only between Amrapali and Rhiti Sports Management Pvt Ltd and there are no signatories on behalf of Chennai Super Kings to this agreement," the court noted.
No resolution on behalf of Arun Pandey,Signatory of Rhiti Sports was attached with the agreement.
The court said "This clearly shows that these agreements have just been made for payment of amounts to Rhiti Sports Management Pvt Ltd Co are sham agreements and made just for making payments to Rhiti Sports Management Pvt Ltd".
"We feel that home buyers money has been diverted illegally and wrongly to Rhiti Sports Management Pvt Ltd and should be recovered from them as the said agreement in our opinion do not stand the test of law."
When Sakshi Singh, MS Dhoni’s wife was the Director of the Amrapali Mahi Developers Pvt. Ltd.. Until the last three years, MS Dhoni was the brand ambassador of the Amrapali Group. Amrapali Group ia a company established for the development of Ranchi and a Memorandum of Understanding was entered between the companies which was not produced in the court.
A flat was booked in the name of Rhiti Sports to make an adjustment in the books said the court, but Sanjay denied it and said neither the company nor any individual has any flat in Amrapali Group
