In Bombay High Court, an interim pre arrest bail to 3 builders in Pune against the arrest by the Kondhwa police station till 30th July for 15 members that were killed by a wall collapse by a wall collapse, on Thursday, by Justice Revati Mohite-Der
Due to the fear of arrest by an FIR lodged by the Pune police, Rashmikant Gandhi and two others sought from the HC. It was argued that the wall was built by another builder in between 2014 and 2018 by Gandhi’s council.
The council made a claim stating that the 3 accused builders Sudhir Shah, Pankaj Vohra and Gandhi of SVG Builders were being blamed for someone else’s mistake. The wall had collapsed on the adjacent plot to the polt that he owned and hence cannot be held responsible for either the wall or the collapse.
In his petition, Gandhi stated that a decade ago, a plot at Kondhwa was owned by Kunal group. Later they had entered into a joint venture with Runwal group. In 2011, excavation work was done on the plot by Kunal-Runwal group and in 2014 "Alcon-Stylus work was started by Aggrawal Builders on their plot which was adjacent.''
Gandhi in the petition articulated that a plot at Kondhwa, was owned by Kunal Group a decade age later they had entered into a joint venture with Runwal Group. Evacuation work was done by the joint venture in 2011 and in 2014, "Alcon-Stylus work was started by Aggrawal Builders on their plot which was adjacent.''
Alcon-Stylus building along with the retaining wall was completed in 2018 while the Kunal-Runwal JV had only constructed a parking structure. In 2018, SGV Builder LLP comprised of the partners Pankaj Vohra, Nilesh Vohra, Suresh Vohra and Gandhi as joint venture with Kunal Group, was stated in the petition.
The SGV builders stated on the month of February that a few jobs were left incomplete by Runwal Group on the plot. Death of 15 workers on Gandhi’s plot was resulted due to the collapse of the retaining wall of Alcon-Stylus. The sessions court on the 1st of July rejected the pre-arrest bail hence Gandhi and two others approached the HC for protection
