The real estate giant Unitech refunded over rupees 53 lakh to two home buyers as they failed to handover the possession of apartment. These directions were given by National Consumer Dispute Redressal Commission. The Apex consumer commission directed the company to refund rupees 53, 73,561 to two residents Abhishek and Mani Agarwal within three months and also a compensation of simple interest at 10% per annum as a result of delay for over 7 years in handing over the possession of apartment.
Justice VK Jain, Presiding Member of the Commission stated, "Refund the entire principal amount of rs.53, 73,561 to the complainants along with compensation in the form of simple interest with effect from the date of each payment till the date of full refund."
Also the firm was asked to pay rupees 25,000 to the home buyers as the cost of litigation.
A project namely “Capella” in universal City in the area of Greater Noida developed by Unitech Reliable Projects Limited had residential apartment which were booked by Agrawals. Unitech assured the home buyers to get the possession by November 30, 2011. Later there allotment was shifted to another project namely “Unitech Verve” and promise was made to deliver the same within 15 months that is by 29th June 2012.
In spite of the promise made by the real estate giant the home buyers were not delivered possession of the apartment after the lapse of 7 year also hence aggrieved by it Agarwal filed complaint against them.
