Decision by the Madhya Pradesh high court to strike down rule as ultra vires will have far-reachingimplications. Not only does it mean that the 4,800 illegal colonies in Madhya Pradesh regularised by the Shivraj Singh Chouhan government before the 2018 state assembly polls will be reduced of the same status again, but all illegal colonies regularize using rule 15 (a) as an instrument since 1998 will be deemed illegal again.
The number of such colonies could well exceed 10,000 as legal colonies were regularized on four occasions since 1998. when rule 15(a) was inserted by the erstwhile Dig Vijaya Singh government. Municipal Corporation Act, 1956, or M P Municipality Act, 1961 has no provision for regularization of illegal colonies.
Secretary, Confederation of Real Estate Association of India Manoj Singh Meek, while welcoming the court decision, said if the government continues to regularise illegal colonies ainstance minimal fee, who would purchase houses in a legal colony?“Evidently, the rule 15 (A) is framed by the state government in exercise of its delegated power under Section 292E of 1956 Act and 339E of 1961 Act.
