A recent order of Delhi High Court has given sigh of relief to residents of Sainik Farm Colony as it has allowed carrying out repairs and renovation including construction of boundary walls. By giving leave of the same, the residents may set a precedent for other such colonies where fresh construction has been totally banned.
A division bench comprising of chief Justice Rajendra Menon and Justice Brijesh Sethi stated that 93 individuals will be granted permission by the South Delhi Municipal Corporation (SDMC) after filing of affidavits.
The residents are aggrieved by the tag of residents of unauthorized colony. Delhi High Court granted relief only after scrutinizing the report of SDMC that the properties of certain residents require certain repairs, whitewash and construction of boundary walls.
Earlier in last month, the court had given list of 155 properties to SDMC to verify their status, after owners came to court for opting permission to carry out minor repairs and whitewash in the buildings.
The construction has been totally banned since 2001, after that complaint was filed by local residents regarding dropping of their plan of renovation and other construction works.
HC later directed the residents to file an affidavit indicating the details and specifics of the houses where the repairs, whitewash etc. were required, along with details of the nature of damage to the houses and the manner in which repairs are intended to be done, which were verified by SDMC later.
Court before passing the orders have taken into consideration the efforts which civic bodies as well as police which at times were engaged in regulating activities of unauthorized constructions at Sainik Farm, also Court earlier interrogated Centre regarding the scheme put forth by Delhi Government for regularizing colonies including the upscale colony of South Delhi.
In preceding year, many complaints of illegal construction were transferred to Supreme Court by Delhi HC and appointed Special Task Force. Numbers of PILs seeking demolition of unauthorized constructions were dismissed.
