Regulation of unauthorized construction is basic motto of every civic body working in specific state. A similar order was passed by Rajasthan High Court with regards to information covering the list of constructions and structures in Walled City violating norms. With failure on part of JMC, a division bench of Rajasthan High Court on Thursday pulled up the JMC for delay in compliance with order.
JMC in their defense stated to court that due to election in state, they could not progress in this task. Accepting the same, now the court has asked corporation to file a detailed affidavit explaining their manner in which work will be resumed and completed.
Court ordered firstly to plan to remove the buildings without permission, tampering the heritage building of Parakota (Walled City). Secondly, to survey the construction sites in Walled city. Also, the court directed the authorities to prepare the action plan in three parts.
First part covering illegal constructions causing highest damage to heritage. Second and third party combinedly covering less acute infringement. Court also asked JMC & JDA to facilitate the amicus curiae.
JMC pleaded Court to give them same more time as they failed to comply with order and could not do much of the data sought by High Court. Amicus curiae in the case Shobhit Tiwari in the court maintained that authorities of the corporation failed to comply with the court orders and whatever datas they have are 6 month old. The bench comprising Chief Justice Ravindra Bhat and Justice KS Ahluwalia asked JMC on why the work was delayed from their side. “The court has directed them to give a detailed affidavit with an undertaking on when and how they will complete the work assigned to them .”
