Tenancy agreement is a legal document which is necessary to regulate the relation between tenant and owner. Tenancy agreement is a very strong defence in case where possession of tenant is taken away due to wrongful act of owner as well. Hence, a legislation governing this needs to be enacted in every state. In order to regulate such in State of Tamil Nadu Regulations of Right & Responsibilities of Landlord & Tenants Act, 2017 is passed which came into effect on February 22, 2019 and in relation to this Government notified some rules. The legislation has made it compulsory to register the rental or lease agreements for implementation of Act.
Earlier, the registration was up to May 22, 2019 but now Tamil Nadu Government has promoted an ordinance to extend it for another four months i.e. till September 22. The decision of extension was taken as a result of registration by people in less number.
This ordinance for extension was issued by law Secretary SS Poovalingam, passed on May 22, 2019 state that, “In Act of Tamil Nadu Regulations of Right & Responsibilities of Landlord & Tenants Act, in sub-section (2) there is a substitution of word i.e. for expression “ninety days” the expression “two hundred and ten days” and thus extended deadline for registration till September 22.
After passing of this Act, if no registration is done then there will be no other legal platform to resolve dispute between tenant and owner arising out of rented properties. A very less number of people approached for registration till May 18, which was only 200 in district of Chennai under the said newly passed Act and hence decision of extension was taken.
It may be recalled that the Tenancy Act has replaced the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960, which is popularly known as the Rent Control Act.
