Bareilly Development Authority (BDA) established in 19th April 1977 under the Uttar Pradesh Urban Planning & Development Act 1973. BDA is the principal agency of the Government of Uttar Pradesh responsible for taking ahead the tradition of planned and sustainable development of Bareilly. The function and aim of authority is to be responsible for preparation and implementation of master plan for the development area. It takes up the infrastructural and basic amenity development for Bareilly besides environment conservation and development of rural areas around the mother city.
In recent drive against illegal construction, the authority caught two builders red handed in area of Vishnu Dham colony at Izzatnagar regarding unauthorized construction at this place. Previously a survey by BDA was held in month of January had sealed certain illegal construction sites as no leave was taken from BDA by builders of those sites, but in some cases inspite of seal by the authority many builders have resumed the work without permission.
An action was taken by the authority by lodging FIR’s against two builders under Uttar Pradesh Urban Planning & Development Act 1973 and IPC. Offences in FIR was lodged under Section 26(1) dealing with Penalties under Act and Section 28 dealing with Power to stop development of Town Planning and Development Act and Section 188 dealing with disobedience to order duly promulgated by public servant and Section 424 dealing with dishonest or fraudulent removal or concealment of property of IPC.
As stated by secretary of BDA, it was found out that the drive which was held in month of January regarding illegal construction resulted in sealing of unauthorized construction of residential area in nearby areas of Izzatnagar as builders failed to produce a BDA-approved building layout plan. Inspite of such strict action taken by authority many builders broke the seal and resumed the work without permission. The decision to file FIR against the builders was a major step taken by authority as it built fear in mind of builders to violate any norms dealing with construction sites.
BDA vice president threw light on the same by stating that it was interpreted earlier BDA only gives warning to builders who breach the rules and don’t penalize them, but now by conducting such timely drives BDA will enforce the laws regarding illegal construction and will file FIR if they non-complied with rules under Act.
