Lodha Developers Has Been Thrown Out By Bombay HC For Gag Orders On Activists

The Bombay HC has given the clean chit to Journalist Krishnaraj Rao and RTI Activists in the case where defamation suit was filed by Lodha developers, which was dismissed by the Bombay HC.

The matter is related to the video, which had gone viral. The video had some views questioning the quality of flats owned by a couple on the new coffee Parade Projection Wadala, leading the defamation suit.

The court observed that Rao had emailed the video which alleges to have the defamatory content to Lodha in advance and gave the developer the opportunity to respond.

Justice Patel had also refused to order a takedown against you-tube sought by the developer. However, Rao’s development was not in the traditional form of print but there is no different stand of law that applies to online journalism or comment.

Further, he stated that a statement is not to be viewed as suspicious only because it is made online or with the help of modern communication channels. Moreover calling out someone with fair comment and justification doesn’t come in the purview of defamation. And hence it was never the case of defamation.
