The renowned footwear manufacturers “Bata” was directed by the Chandigarh District Consumer Forum to pay Rs 3000 as compensation and Rs 1000 towards the litigation expenses to a complainant from whom they charged Rs 3 extra for a carry bag.
The forum was held for indulging in unfair trade practice by charging the consumer for the carry bag bearing its advertisement. The consumer Dinesh Prashad has purchased a pair of shoes from Bata shop for Rs 399. An extra Charge of Rs 3 for the carry bag which he had no intention to purchase. Dinesh complained of being used as an ‘advertisement agent’ by bata at his cost and this amounted to Unfair Trade Practice.
In its decision consumer forum held that “Advertisement of the Bata company as it has been printed on the carry bag shows that Bata used the consumer as if he is the advertisement agent of the opposite party. This amounts to unfair trade practice as Bata is minting a lot of of money from all customers.”
The Consumer forum granted compensation worth Rs 4000 to the consumer along with a refund of Rs 3 charged for carry bag and also directed Bata to provide free carry bags to all the customers who purchase articles from its shop.
