An appeal was made by income tax department against the order passed by Madras HC in the alleged black money case wherein the Congress leader P. Chidambaram’s wife (Mrs. Nalini Chidambaram) and son (Karti) were allegedly involved.
SC bench headed by chief justice RajanGogoi, while issuing notice, clarified that it will not stay Madras HC’s order quashing criminal prosecution against Chidambarams.
The issue around which the whole case of black money revolves is that allegedly non-disclosure of all the overseas assets and bank accounts are owned by Chidambaram’s wife, son, and daughter-in-law.
As per the Income tax department, all the three had not disclosed their jointly owned property at Cambridge in the UK. The worth of the property is Rs. 5.37 crore and this is not disclosed while paying the income tax returns, which amount to an offense under the Black Money Act and Imposition of Tax Act.
In 2018 the Madras HC quashed the criminal prosecution and said that no case was made out.
The department had allegedly said that Karti has not disclosed his overseas bank account, which he holds in Metro Bank at the UK and all the investments he made in Nano holding LLC, USA.
