The Law Commission suggested that there is a need to recognise the role of woman in a household regardless of her financial contribution and she should get an equal part of the property gained after marriage upon divorce. It also stated that all personal and secular laws should be amended accordingly.
However this principle does not amount to equal split of property at the end of a relationship because it might become an unfair burden on one of the parties. It is often the women who compromise on careers in order to support families and they also contribute to a major share of housework which is never calculated in terms of money.
This principle does not include inherited or ancestral property, although its value can be taken into account by the court for determining maintenance and alimony.
