The High Court of Bombay has requested the central council and the Maharashtra Coastal Zone Management Authority to make an account of their responses, on the said allegations about many clearances for given proposed Shivaji memorial off the Arabian Sea that have said to be illegal since then, Bombay HC awaits MCZMA’s replies, on accused unlawful clearances on the shivaji memorial case.
The Bombay High Court bench of justices comprising of Shantanu Kemkar and Sarang Kotwal, on August 28, 2018, asked the authorities to question (using affidavits) the several legal issues that have been brought to light in several the of public interest litigations (PILs) filed in the High Court, questioning the illegal nature of construction of the Shivaji memorial off the Arabian Sea. After senior advocate Aspi Chinoy who is representing most of the petitioners, highlighted in front of the Court that the Maharashtra Coastal Zone Management Authority (MCZMA), the central and the state government has currently granted most approvals to the said project which have been in major violation of the coastal zone norms.
Chinoy informed the Bombay HC bench that the state and the MCZMA has granted approvals to the project, without conducting a public hearing. In which Citizens could raise objections and give suggestions on a public project and it is mandatory hearing and absolutely cannot be disregarded or avoided, as per environmental and coastal zone norms, Chinoy said.
The HC still awaits answers with regards to the given allegations of the said project of shivaji memorial and it's unlawful nature.
