In addition to the already controversial matter of women's right in india, there is a new question being raised in New Delhi-should women be given 50% of the property after divorce regardless of her financial contributions?
The law panel in New Delhi chose to say the following "There is a need to recognise the role of woman in a household and regardless of her financial contribution, she should get an equal part of the property gained after marriage upon divorce", on Friday.
They also suggested that all personal and secular laws regarding the same should be amended in favour of the statement, but while doing so they also cautioned against the "unfair split" of the household by saying that there should not be an absolute split, they said the following "Thus, it is important to retain the discretion of the court in such cases," the commission said in its consultation paper that was written on the topic of/titled 'Reform of Family Law'.
It said all property retained after marriage of either spouse be treated as a unit between the couple. "The Special Marriage Act is described as a 'secular law' as inter-faith marriages are solemnised under it. Instead of a full-fledged report on a uniform civil code, the law panel preferred a consultation paper as it had little time at hand to bring out a comprehensive report", said various associates and spectators to the panel.
The panel addressed the matter that it is very often women who sacrifice their career in order to support the family and provide for them proving that even if not financial the woman of the household contributes as much as the man. Therefore it is only fair that 50% property is transferred to her after the split of the couple.
