On Friday, a former judge of Delhi High Court approached the HC for sealing of her property alleging misuse of property. The Supreme Court appointed monitoring committee ordered the sealing.
Retired Justice Usha Mehra, who has also served Law Commission of India challenged the directive sealing ground floor and front half of lower ground floor of her property in Hauz Khas.
The monitoring committee had stated that a wellness diagnostic centre was operating in the premises, which has violated the Delhi Master Plan 2021 and directed the owner show-cause so as to why the property shouldn't be sealed.
She told the court that she had purchased the property in 2011 and 2013 and the original owner had paid required conversion charges to the municipal corporation for commercial use of ground floor and front basement.
She stated that the use of basement to carry out professional activities, such as services of a doctor or lawyer are not prohibited under any law, including Master Plan.
She has accused the committee of 'flagrant misrepresentation of actual facts' since it claims both areas of property have a diagnostic centre running when in fact the basement is occupied by a doctor.
