A bench of acting Chief Justice Gita Mittal and Justice C Hari Shankar was upset over the ongoing state of affairs in Delhi relating to illegal construction and unauthorised colonies. Their criticism against the government authorities for violation of laws cannot be ignored as it is affecting the lives of many citizens residing in Delhi.
The PIL for the same was filed by an Advocate Arpit Bhargava, claimed that the National Capital currently has over 1,700 unauthorised colonies with more than 50 lakh people living in them and it has been realized that around 90% of buildings in Delhi do not comply with safety norms. He also put forth his views by stating that there are Delhi Laws (Special Provisions) Second Act, 2011 which contains safety norms, National Building Code, 2005 and various other laws which are not properly and timely implemented by these authorities.
The petitioner claimed that illegal constructions have come up infringing upon the National Building Code 2005 for seismic zone IV, in which Delhi falls, and the order of the High Court that no building ought to be permitted to come up without agreeing to the standards.
Advocate Bhargava sought directions to the local authorities like the municipal bodies, the Delhi Development Authority (DDA) and the Delhi government, ‘to stop regularisation of any unauthorised colony, till infrastructure development has taken place in all such colonies and safety norms are complied with’. He also tried to come up with fixing the accountability on the officials who backed their sanctions to such unauthorized colonies. The PIL also claimed that in a court order it was revealed that merely 10-15% of Delhi's buildings comply with the building code.
