In a petition filed by an organization Jyoti Jagran Mandal, the apex court on Friday referred it to CJI to constitute a larger bench to ascertain the question in petition.
The bench comprising of justices RF Nariman and Indu Malhotra said, “the issue of petition whether such religious events can be allowed on public properties or not is an important one as India is a secular state.”
This petition challenged an order by the National Green Tribunal (NGT) denying it the permission to hold a ‘jagran’ and ‘Mata ki Chowki’ at a park in south-west Delhi.
“We think what the NGT has done is right,” said justice Nariman. Fuzail Ayyubi, the lawyer representing the organization submitted that ‘Mata ki Chowki’ is similar to ‘Ram Leela’ which the NGT had allowed in October 2017 verdict.
