The inspector general of registration has issued a circular stating that bank documents will be sufficient for registering properties if the parent documents are with financial institutions. This comes after the department mandated submission of parent documents for registration. However, after receiving complaints from the public stating that many of these documents are in the possession of banks, they have now eased the process considerably. People can furnish statements from banks stating that the parent documents are in their possession. This statement will be considered as a document for the purpose of registration, in case the concerned property is mortgaged. However, this will not apply in case of resale of the property. Further, for laminated parent documents, a written undertaking is compulsory. This undertaking cannot be scanned and must be submitted for registration.
The submission of parent documents was made compulsory to prevent fraudulent registrations, where the sub-registrar had to scan every document prior to registration of property. However, since it imposed a burden on those who were not in possession of these documents and also lengthened the process due to the scanning, the department issued these clarifications to ease the procedure.
