Overview

No Objection Certificate (NOC) by a Landlord becomes necessary when a Tenant (usually for a company), who has taken a property on lease from the landlord, plans to use the premises or a part of it as a registered office.
Importance Of NOC By Landlord

Prior setting up a company’s registered office in a rented premises, the company has to get a No Objection Certificate by the landlord. It basically states that the landlord issuing NOC has willingly rented the premises to the company and has no objections for the premises (or a part of it) to be be used as the company’s registered office.
Details To Be Included In NOC By Landlord

The elements listed below have to be included in an NOC by Landlord:

    Name of Landlord
    Name of the Company to which the premises is rented out to.
    Address of the rented property
    Date
    Place
    Signature of the Landlord
    Contact details of landlord (optional)

How To Make No Objection Certificate?

To create the No Objection Certificate by Landlord, you will have to follow the steps below:

    First draft the NOC by including all the details mentioned above
    Get it printed on a plain white paper
    Place landlord’s signature on the document

Question :  Hello, I want advice on property registration. I have flat of 900 super built up area in Patna which I want to sell for Rs 27 lakhs. A buyer has agreed and an agreement has been made accordingly. However as per valuation the value of a property of 900 sq feet in my area is Rs 36 lakhs. Now the buyer wants to register the sale deed at Rs 36 lakhs. As payments will be made to my bank account, what will be the legal aspects and tax problems as payment amount will be Rs 27 lakhs,and I shall have to pay income tax accordingly. Please advice on the course of action to be taken. Thank you

Answer by Law chamber :  Yes you have to pay income tax on 36 lakhs you shoud avaid that you can do sale deed 27 lakhs ok
