Question : I purchased 3 non-NA plots from a seller on the condition that he will NA those plots in next 3 months. After 3 months, he started making reasons that the land has some problems. He asked us to wait for some time. Now Its been 7 years and he is giving me the same reason. I requested him to at least pay the money back but he is unnecessarily delaying that for the past 1 year. The seller is neither interested in giving me the plots nor the money back. How can I file a case against that fraudulent seller? Or what could be the best way to recover my money?

I hope that you have an agreement while advancing money to the seller,then you may bring a civil action against the seller for specific performance of contract.Beside that you may file a criminal case against him for cheating if you wish.

file a police complaint for fraud, cheating at the earliest, also if you know other plot buyers, contact them and make them also file complaints against the person

If you have given part payment to the seller than you can file suit for specific performance of contract. If the seller while selling the plot in the agreement if he had written that he will obtain NA order and will give you than you can file FIR u/s 420

Could you explain why were you sleeping for 7 years because no prudent person will stay quiet over for 7 years, your claim becomes time barred after 3 years . but even if you try and hire a good lawyer , it will require lot of effort. what was your mode of payment also you have not attached the copy of Agreement which was entered. Also specify what was the document that you saw of his ownership . did you retain the copy of it. Did you verify the ownership documents. answer these queries only then some advice can be given.

It is not mentioned under what deed you have purchased the said non NA plots. Because on the said deed only your claim will rest. Further there is already a delay of well over 7 years. My opinion will be only after verifying further contents of the deed and document executed between you and that person.

This is a clear case of cheat. Please file a criminal complaint before the local police authority. If your grievances are not solved, then you can approach the local magistrate Court for a direction upon the police to take legal action against that person, so that your money can be recovered..
