Question :  I purchased 3 non-NA plots from a seller on the condition that he will NA those plots in next 3 months. After 3 months, he started making reasons that the land has some problems. He asked us to wait for some time. Now Its been 7 years and he is giving me the same reason. I requested him to at least pay the money back but he is unnecessarily delaying that for the past 1 year. The seller is neither interested in giving me the plots nor the money back. How can I file a case against that fraudulent seller? Or what could be the best way to recover my money?

Can u please tell me what is NA? Did u and the Seller had an agreement to sale? Now u have two option 1. File a Suit for recovery of money i.e. Total amount plus Interest. 2.File a suit for specific performance of contract, where court orders the seller to abide by the Agreement to sell. As there is a land dispute i recommend you that 1. option as you can recover all the amount.

Now, you can go to the court claiming the plot be registered in your name otherwise your money should be got refunded.

u first have to get agreement reneu .Because as per limitation u have to take action within 3 yrs ehich already laps.so first revise agreement.make condition of three month or as agree again.then after passing of that period u got right to file civil suit as well ad criminal complaint under section 420.

You have two options with yourself - 1. If the seller is a company then you can bring up a suit of fraud against him on the name of land purchase under section 420 of IPC seeking prison imprisonment for him and a case before consumer court seeking your money with interest rate as well as compensation for the harassment which you have gone through. 2. If the seller is an individual party then you can bring up a suit of fraud against him on the name of land purchase under section 420 of IPC seeking prison imprisonment for him and a case before civil court for permanent injunction seeking your money with interest rate as well as compensation for the harassment which you have gone through.

Its a civil matter you can file a case against plot seller in civil court.

This is a clear case of cheat. Please file a criminal complaint before the local police authority. If your grievances are not solved, then you can approach the local magistrate Court for a direction upon the police to take legal action against that person, so that your money can be recovered.
